Husband's General Notes
Thomas Cook made a will dated February 1, 1805, as follows:
I, Thomas Cook, of the county of Guilford, and the state of North Carolina, being of sound mind and disposing memory, do ordain this my last will and testament, in manner form following:
It is my will that all my just debts be paid; and first, I give and be queath to my beloved wife, Mary Cook, the use and profits of the plantation that I now live on, with all the farming tools thereto belonging, with the two mares, one called Fly and another called Blaze, with two cows and calves such as she may choose, all during her widowhood, but it is my will and meaning that if she should incline to marry, as so on as she doth that, she shall have but one feather bed and common furniture. All her wearing clothes are to be hers and her heir's forever .
I also give unto my son Thomas Cook, ten dollars, to him and his heirs forever. I also give unto my son Joseph Cook, ten dollars , to him and his heirs forever. I also give unto my son John Cook, the blacksmith tools that he has now in use, and the horse that is now called his, with one feather bed and common furniture, to him and his heirs for ever. I also give unto my son Jacob Cook, the mare called Polly, to him and his heirs forever. I also give unto my son William Cook, the two year -old horse colt and fifty dollars, to him and his heirs forever .
I also give unto my three sons Zimri Cook, Isaac Cook and Nathan Cook , at their mothers decease or marriage, the plantation that I now live on, with every privilege thereto belonging, provided that there remains residue enough of my personal estate to pay William the fifty dollars above mentioned. If not then to pay the fifty dollars equally among them, and the remainder I give to them and their heirs forever .
I also give to my daughter, Sarah Stewart, ten dollars, to her and her heirs forever. I also give unto my grand - daughter Elizabeth Cook , one feather bed and common furniture, to her and her heirs forever .
And it is my will and meaning and I want it to be understood, that if either of my sons die in minority, or without heirs of body, that part and personal, or nature so ever, to be equally divided among the remainder of my sons .
And lastly, I do make, ordain, constitute, and appoint my two sons Joseph Cook and Thomas joint executors of this my last will and testament, utterly revoking and disanulling all other wills by me made or intended, ratifying this and no other to be my last will and testament . In witness whereof I have hereto set my hand and seal this first day of t he second month, 1805.
